Included Moral Compensation: A Ruling to Compensate an Employee of “Misr Exchange” with More Than 350,000 EGP for Arbitrary Dismissal

The South Cairo Primary Court, in case number 583 of 2024, heard before the 18th Full Labor Circuit, ruled to compensate “Ahmed A. K.” with an amount of 353,756 EGP for his unjust dismissal from “Misr Exchange” company, in addition to notice period compensation and accrued leave balance, as well as moral compensation.

The facts of the case date back to 2024, when the plaintiff started working for the defendant company on January 1, 2009, in the position of Branch Manager in Aswan, with a comprehensive monthly salary of 6,424 EGP, and was covered by social insurance.

The plaintiff continued working for the defendant company until, on December 12, 2023, he was abruptly terminated and barred from performing his duties, being informed of his dismissal. He made several amicable attempts to persuade the defendant company to retract this arbitrary decision, but to no avail. Consequently, he went to the October Police Station and filed administrative police report number 936 of 2024, First Administrative Aswan, in an attempt to resolve the matter amicably, which also failed. This led him to the labor court to directly file a labor lawsuit to claim his legally entitled rights.

The case was registered in the docket of the South Cairo Primary Court under number 583 of 2024, South Cairo Labor Major, to be heard before the 18th Labor Circuit on Monday, and it was deliberated in sessions.

In the session held on May 27, 2024, the court ruled obligating the defendant in his official capacity to pay the amount of 257,720 EGP as material and moral compensation for the arbitrary dismissal, 19,272 EGP for the notice period, and 67,764 EGP for the accrued but unused annual leave balance not paid in cash, and to provide the plaintiff with a certificate of his experience during his period of employment, including the details stipulated in Article 130 of the Labor Law.
