Upholding the judgment rejecting the dismissal of an employee from “El-saeed Contracting Co.” and the ruling to pay his overdue payments

On January 16, 2024, the Egyptian Center for Economic and Social Rights (ECESR) obtained a ruling from the Cairo Court of Appeal, Abbassia Appeal, in the appeals No.1558 & 1761 of the judicial year No.27. The court affirmed the first-degree judgment in the lawsuits No.6008 & 6037 of 2022 before North Cairo Labor Court, issued on February 23, 2023, in favor of the worker “Essam A,” rejecting the decision to dismiss him from the El-saeed General Contracting Company. The decision of the Court affirmed his return to his work together with receiving his full salary payment, in addition to settling his overdue payments and vacation balance.

It is noteworthy that the company decided to suspend the worker from work accusing him of stealing attendance and departure registers, posting them on social media, and leaking them, the court acknowledged that the worker did not commit any violations warranting dismissal. The court deemed the suspension decision unacceptable, requiring the payment of his salary and entitlements for the entire work period.
