Guidance Paper | Rights of Private Sector Workers in Cases of Dissolution, Liquidation, Closure, or Bankruptcy Declaration
In light of recent changes in both the Egyptian and global labor markets, coupled with severe economic conditions, workers are increasingly facing challenges due to attempts by some employers to exploit these circumstances to evade their obligations towards workers. This includes evading the payment of workers’ dues for various reasons or avoiding the enforcement of court judgments issued in the workers’ favor. Such employers often resort to measures such as total closure, declaring bankruptcy, selling company assets, or other similar actions.
Given that Egyptian Labor Law No. 12 of 2003 addresses these manipulative practices, the lawyers of the Egyptian Center present a concise guidance paper on the legal framework governing these issues and the means to confront them
This guidance paper is issued in recognition of the urgent need to combat practices that subject workers to de facto policies that undermine their rights, despite the fact that they are the essential driving force of the labor system. It is imperative to work towards protecting and guaranteeing their rights rather than subjecting them to arbitrary measures and to provide the legal mechanisms necessary to safeguard their interests in the face of current economic changes
