The Egyptian Center obtains a judgment, compensating a worker at Universal Group with 200 thousand pounds, as a result of his arbitrary dismissal

The Egyptian Center for Economic and Social Rights (ECESR) obtained a new judgment, compensating a worker at Universal Group for Engineering Industries with EGP 200.000, due to his arbitrary dismissal.

On December 27, 2022, South Giza Court of First Instance issued a judgment in Lawsuit No.348 of 2022, for Ahmed Al Saadi against Universal Service Group, by obliging the Company to pay him EGP 200.000 as a compensation for arbitrary dismissal, the period of notice, accrued leave balance, and his delayed salary.

The plaintiff said that he works at the company as a supervisor in the systems and information department. On January 28, 2022, he was prevented from entering the workplace, as he was fired from the company without committing any violation that deserves dismissal. He called for his right to return to work, and asked for a compensation for the financial and moral damages that he suffered as a result of the decision, and in return for the period of notice, together with employment documents, and the financial compensation for his unused leave balance, in addition to his share of the profits since 2016.

on the merits of the Case, the Court issued a judgment by obliging the Company to pay EGP 160.000 as a compensation for the financial and moral damages occurred to the worker due to the dismissal decision, together with EGP 17634 in return for the period of notice, EGP 2460 for the unused leave balance, and EGP 19397 for his salary from January 2021 to January 2022.

During the past months, the legal defense team of the Egyptian Center for Economic and Social Rights received 60 complaints of arbitrary dismissal from the workers of Universal Group Co., at the time when the Company’s Administration violated the previously ratified collective labor agreements between it and the workers’ representatives, and in the presence of the Ministry of Manpower representatives.

The Center’s lawyers were surprised that the Company’s legal representative submitted requests to the Labor Court to dismiss the workers, in a new episode of manipulation of the fate of these workers, together with putting them under the pressure of displacement and deprivation of wages, in light of the absence of any tangible role from the responsible authorities of the Ministry of Manpower and Immigration.

The workers suffer from the deterioration in the salary and wages system that led to stopping the production in the Company’s factories, as well as the Administration’s manipulation in the workers’ wages which led to bad living and material conditions, which, in turn, resulted in one worker’s attempt to commit a suicide in last February, in addition to other crises.

The Egyptian Center for Economic and Social Rights indicated that wage manipulation is not the only crisis that workers face, as they face a crisis in the absence of some occupational safety and health factors in the workplace, which led to the injury of a number of them with cirrhosis, kidney diseases, and limb injuries that led to its amputation, according to their affidavit.
