Court Rules On Reinstating State Ownership of Tanta Flax and Oil Co.

In a new win for Egyptian workers, the Administrative Judiciary Court issued new historic rulings to reinstate Tanta Flax and Oil Co. workers and reinstate the state ownership of the company. The court upheld the previous ruling to nullify the company sale contract and all ensuing effects.

Over the past few years, Egyptian judiciary adjudicated various cases filed by workers against sale contracts and by holding companies against rulings in favor of workers. The first ruling in favor of Tanta Flax workers was issued on 21 September 2011. Then on 29 September 2013, the Supreme Administrative Court upheld the ruling.

The latest ruling issued on 27 June 2015 was awarded in the case filed by the Chemical Industries Holding Company to request clarification for the previous ruling concerning the workers who will return to their previous positions. The court ruled that they are all workers on the company workforce a day before the sale.

The state, as represented by the Chemical Industries Holding Company, stalled in the execution of the September 2011 ruling by challenging the ruling and filing a lawsuit to specify the workers concerned. The latest ruling means 450 of the workers will be back to work in the reopened factory after forced into early retirement. They will receive all their dues since the date of their early retirement.
