A judicial ruling rejects the dismissal of a “New Star” worker and orders the company to pay his financial dues
The Labor Court in Port Said ruled on April 28, 2024, to reject the dismissal of “Ayman M. A.” from ” New Star Manufacturing & Export of Ready Made Garments,” and ordered the company to continue employing the worker and pay his financial dues.
The plaintiff had been working for the company under an unspecified-term employment relationship since 2014, until the company’s management decided to arbitrarily suspend him from work for a period exceeding the legal limit of 60 days. This prompted the worker to file a complaint to the labor office to request his return, Moreover, the company filed a complaint to the labor office to request his dismissal and retained its right to compensation.
The Egyptian Center as an attorney on behalf of the worker, filed a lawsuit No.463 of 2023 in the Port Said Labor Court, to demand the annulment of his suspension from work for exceeding the legal limit, and to resume his work with receiving full payment of his salary for the period of suspension, in addition to obliging the defendant to pay the plaintiff’s salary for October 2023.
Meanwhile, the company filed a lawsuit to demand the dismissal of the worker on the grounds of committing a serious mistake that resulted in financial losses for the company, along with a request to compel him to pay compensatio of 4,905 US dollars.
The dispute was referred to the competent labor court, and the case was scheduled to April 28, 2024, during which the aforementioned ruling was issued, in addition to obliging the company to pay 1,748 EGP for the plaintiff for his October 2023 salary, as well as legal fees.
