Court Orders “Sa’eed for Electrical Appliances” to Pay Over EGP 330,000 in Compensation for Arbitrary Dismissal

On April 29, 2025, the Second Labor Circuit of the South Giza Primary Court issued a judgment obliging Sa’eed for Electrical Appliances to pay its former employee more than EGP 330,000 in compensation for arbitrary dismissal. The compensation includes damages for unfair termination, payment in lieu of notice, accrued but unused annual leave, and unpaid wages. The court also awarded legal interest on some of the awarded amounts at a rate of 4%, calculated from the date of judicial claim on February 19, 2025, until full execution of the judgment.

The case—registered as No. 48 of 2025—originated in 2024, when the plaintiff, A.A.A., began employment with the defendant company in September 2018 as a Maintenance Department Officer. He was later promoted to Administrative Affairs Officer in the Human Resources Department, and eventually to the position of Human Resources Officer for the entire company. He received a monthly salary of EGP 15,300.

The plaintiff remained in his position until November 14, 2024, when he was unexpectedly denied entry to the workplace by security personnel without prior notice. He was verbally informed of his dismissal without any legal or legitimate justification—an act the court deemed to constitute arbitrary dismissal in violation of Egyptian Labor Law.

Following this incident, the plaintiff filed a formal complaint with the October 6 Labor Office on November 18, 2024 (Complaint No. 3474 of 2024), asserting that he had been arbitrarily dismissed. Attempts to reach an amicable resolution failed due to the company’s refusal to cooperate.

After the failure of amicable settlement efforts, the plaintiff requested that the complaint be referred to the competent court. The case was registered under No. 48 of 2025 and was heard by the Second Labor Circuit of the South Giza Primary Court. A final judgment was rendered on April 29, 2025. The plaintiff was represented by Attorney Mahmoud Abdel Rahim from the Egyptian Center for Economic and Social Rights.

The judgment ordered the defendant company to pay the plaintiff EGP 200,000 in material and moral damages for arbitrary dismissal; EGP 30,600 in lieu of notice; EGP 37,740 in unpaid wages covering the period from September 2024 through the date of dismissal in November 2024; and EGP 64,260 for accrued but unused annual leave, for which no compensation had been paid.

The court further awarded the plaintiff legal interest of 4% on the amounts due for unpaid salary and unused leave, calculated from the date of filing the lawsuit until full execution of the judgment. Additionally, the court ordered the company to issue an employment certificate for the plaintiff covering the full period of his service, in accordance with Article 130 of the Egyptian Labor Law.
