Court Orders Reinstatement of Pension and Financial Compensation for Former Employee of Al-Beheira Joint-Stock Company

On May 31, 2025, the Damanhour Court issued its judgment in Case No. 557 of 2023, ordering the reinstatement of the pension of Mr. H. M. A., a former technical employee of the Al-Beheira Joint-Stock Company. The court affirmed his entitlement to all outstanding financial arrears accrued during the period of pension suspension. The lawsuit was filed against the President of the National Organization for Social Insurance.

The claimant brought the case after his pension payments were suspended in early 2021, despite his eligibility for pension benefits since opting for early retirement in 2018 following a voluntary termination of his employment. Pension payments had been disbursed regularly for three years before the suspension, which occurred without any clear legal justification.

The Egyptian Center for Economic and Social Rights (ECESR) represented the claimant. During the proceedings, the Center’s legal counsel petitioned the court to refer the case to the Damanhour Office of Experts to assess the claimant’s entitlement to resume pension payments and calculate the financial differences resulting from the suspension.

During the investigation phase, the representative of the Social Insurance Authority alleged that the claimant held a private driver’s license and was engaged in alternative employment, which the Authority cited as grounds for terminating the pension. However, the claimant’s legal counsel submitted official documents refuting these claims.

Upon the conclusion of the expert report and submission of all legal memoranda, the court issued its final ruling in favor of the claimant, confirming his right to resume receiving his pension and to collect all financial entitlements withheld during the suspension period.

The Egyptian Center for Economic and Social Rights welcomed the ruling, describing it as a significant victory for the right of citizens to social security and a dignified retirement.
