The North Giza Court of First Instance has ruled in Case No. 39 of 2026, ordering Misr Helwan Spinning and Weaving Company (El-Shorbagy Unit) to pay a member of the Board of Directors of the company’s Workers’ Trade Union Committee his outstanding financial entitlements, consisting of the additional allowance due from 1 May 2024 and the transportation allowance due from 1 July 2025 until the date of the judgment.<\/p>\n

The case was brought by the Egyptian Center for Economic and Social Rights (ECESR) on behalf of an employee of Misr Helwan Spinning and Weaving Company (El-Shorbagy Unit). According to the case file, the claimant joined the company in Imbaba, Giza, under an employment contract in 2006 as Second Department Head \u2013 Textile Quality. His gross monthly salary increased over time until it reached EGP 5,850.<\/p>\n

In 2021, a decision was issued to merge El-Nasr Spinning, Weaving and Knitting Company (El-Shorbagy) into Misr Helwan Spinning and Weaving Company. Following the merger, El-Shorbagy became one of the company’s operating branches, with the latter\u2014represented by the defendant\u2014assuming all legal rights and obligations arising from the merger.<\/p>\n

The claimant was duly elected as a member of the Board of Directors of the Workers’ Trade Union Committee of El-Nasr Spinning, Weaving and Knitting Company (El-Shorbagy) for the 2022\u20132026 trade union term. The election results were officially published in Issue No. 146 (Supplement) of the Egyptian Gazette (Al-Waqa’i Al-Misriyya) on 29 June 2022, pursuant to Minister of Manpower Decree No. 107 of 2022.<\/p>\n

Before the merger, El-Nasr Spinning, Weaving and Knitting Company (El-Shorbagy) granted its employees the following employment-related financial benefits:<\/p>\n

    \n
  1. an additional monthly allowance of EGP 300;<\/li>\n<\/ol>\n
      \n
    1. a daily attendance allowance of EGP 50;<\/li>\n
    2. a daily transportation allowance of EGP 25; and<\/li>\n
    3. an annual Mawlid al-Nabi grant of EGP 250.<\/li>\n<\/ol>\n

      However, effective 1 May 2024, the claimant was unexpectedly deprived of the additional monthly allowance of EGP 300. Subsequently, on 1 July 2025, the company also ceased paying his daily attendance allowance of EGP 50 and daily transportation allowance of EGP 25 and further denied him the 2025 Mawlid al-Nabi grant.<\/p>\n

      The defendant did not disclose any reason or legal basis for suspending these financial entitlements. The claimant exhausted all reasonable efforts to persuade the company to reverse what he considered an unjustified decision or, at a minimum, to explain the grounds for withholding the benefits. Those efforts proved unsuccessful due to the company’s refusal to reconsider its position. Consequently, the claimant filed a complaint with the Imbaba Labour Office.<\/p>\n

      After the Labour Office was unable to facilitate an amicable settlement, the claimant requested that the dispute be referred to the competent Labour Court to pursue his statutory employment rights. The complaint was subsequently referred to the North Giza Labour Court, where it was registered as Case No. 39 of 2026 and assigned to the Second Labour Circuit.<\/p>\n

      At the hearing held on 24 June 2026, the Court rendered judgment ordering the defendant company to pay the claimant all outstanding employment entitlements that had remained unpaid, specifically the additional allowance accruing from 1 May 2024 and the transportation allowance accruing from 1 July 2025, up to the date of the judgment in the present case, 24 June 2026.<\/p>\n
