The case has attracted attention due to a landmark report issued by the State Commissioners Authority, which recommended recognizing the petitioner\u2019s right to obtain samples and medical tests from her husband, who is serving a 15-year prison sentence at the Minya Reform and Rehabilitation Center, to complete an IVF procedure.<\/p>\n
In its April 2025 report on Case No. 41283 \/ Judicial Year 79, the Authority affirmed that the Egyptian Constitution defines the family as the cornerstone of society and places responsibility on the state to preserve its unity and values. It further noted that penalties must be based strictly on law, imposed only by court judgment, and never applied retroactively.<\/p>\n
The report also referenced rulings from both the Supreme Administrative Court and the Supreme Constitutional Court, which have consistently recognized personal liberty as one of the most fundamental constitutional rights \u2014 including the right to marry and to start a family. This entails that individuals in detention must be treated in a manner that upholds their human dignity.<\/p>\n
As part of its legal reasoning, the Authority cited the European Court of Human Rights\u2019 ruling in Dickson v. the United Kingdom, which dealt with a prisoner\u2019s right to family life. The Court found that incarceration does not automatically strip a person of their fundamental rights and that granting access to assisted reproductive services does not pose a significant burden on state resources or security.<\/p>\n
In that case, Kirk Dickson, a prisoner serving a life sentence for murder, and his wife Lorraine Dickson applied to British authorities for access to IVF services. Their request was denied, but the Grand Chamber of the European Court ruled that the refusal violated Article 8 of the European Convention on Human Rights, which guarantees respect for private and family life.<\/p>\n
The Authority also drew on the United Nations Standard Minimum Rules for the Treatment of Prisoners (the Nelson Mandela Rules), which affirm the state\u2019s obligation to provide prisoners with access to health care equivalent to that available in the community \u2014 including necessary medical services, free of charge and without discrimination based on legal status.<\/p>\n
In addition, the report cited Presidential Decree No. 536 of 1981, which ratified the International Covenant on Civil and Political Rights (ICCPR). The ICCPR affirms in Article 6 the inherent right to life and prohibits arbitrary deprivation thereof; Article 9 guarantees the right to liberty and security of person; and Article 10 requires the humane treatment of all persons deprived of their liberty, with respect for their inherent dignity.<\/p>\n
Article 23 of the Covenant further reinforces the family\u2019s status as the natural and fundamental unit of society and entitles it to protection by the state, recognizing the right of men and women of marriageable age to marry and form a family.<\/p>\n
The Authority also referenced Law No. 396 of 1956, as amended by Law No. 14 of 2022, which governs correctional and rehabilitation centers and affirms the rights of prisoners to humane treatment, visitation, and health care \u2014 including access to medical tests and necessary treatment.<\/p>\n
Based on these legal foundations, the Authority concluded that since the law guarantees a prisoner\u2019s right to health care \u2014 including the possibility of being transferred to external hospitals for necessary treatment \u2014 permitting a wife to obtain a medical sample from her imprisoned husband for IVF is consistent with both the Constitution and applicable law.<\/p>\n
The Egyptian Center for Economic and Social Rights welcomed the report, describing it as a historic step forward, and expressed hope that the court would adopt its recommendations in the final judgment, based on the clear legal reasoning and international precedents cited.<\/p>\n
The lawsuit was filed jointly by the ECESR and the law office of Attorney Ehab El Garhy before the Administrative Court in Cairo. It names the Minister of Interior, the Assistant Minister for Human Rights, and the Director of the Community Protection Sector in Minya, in their official capacities. The petitioner is seeking to overturn the authorities\u2019 refusal to grant her access to biological samples and medical tests from her husband \u2014 who is serving a 15-year sentence \u2014 to undergo IVF at her own expense.<\/p>\n
According to the lawsuit, the petitioner \u2014 a resident of Fayoum Governorate \u2014 married her husband in 2014, and the couple enjoyed a stable marital relationship. They struggled with delayed fertility and, after several attempts, the petitioner successfully conceived triplets through IVF. However, following her husband\u2019s arrest in January 2015, and subsequent sentencing in 2022, the psychological toll caused her to miscarry, shattering their shared dream of becoming parents.<\/p>\n
The lawsuit explains that the petitioner, now 36 years old, faces sharply declining fertility and is no longer physically able to conceive naturally. Moreover, she will not be reunited with her husband until 2037, the end of his prison term \u2014 making IVF her only realistic option for motherhood.<\/p>\n
She submitted an official request to the Ministry of Interior, proposing to undergo IVF at her own expense and affirming that the procedure would not violate any laws or present any security concerns. However, the authorities failed to respond, prompting her to seek legal intervention through the ECESR.<\/p>\n
The petition stresses that the request is lawful and involves a necessary medical procedure aligned with legal provisions that guarantee prisoners access to health care.<\/p>\n
It is important to note that Egyptian legislation does not currently include provisions allowing conjugal visits for prisoners, effectively depriving them of basic marital rights and the possibility of natural conception. While religious fatwas have affirmed that prisoners should not be denied such rights, the matter of conjugal visits remains at the discretion of prison authorities.<\/p>\n
In 2017, the Al-Azhar Global Center for Electronic Fatwa confirmed there is no religious prohibition against IVF, emphasizing that preserving offspring is one of the higher objectives of Islamic law, which must be respected and safeguarded.<\/p>\n
