rejects the appeal of the governor of Dakahlia to the opposing claims concerning preventing journalists from entering government bodies The ruling confirms the rulings obtained by the Egyptian Center from the &#8220;Administrative Judiciary&#8221;"},"content":{"rendered":"<p class=\"s3\" style=\"text-align: left;\"><span class=\"s5\"><span class=\"bumpedFont15\">The Supreme Administrative Court, in its first circuit, rejected the appeal filed by the governor of <\/span><\/span><span class=\"s5\"><span class=\"bumpedFont15\">Dakahlia<\/span><\/span><span class=\"s5\"><span class=\"bumpedFont15\"> in his capacity, against a number of journalists on the grounds of preventing them from entering the governorate building, and deleting them from the WhatsApp group of journalists and media professionals.<\/span><\/span><\/p>\n<p class=\"s3\" style=\"text-align: left;\"><span class=\"s5\"><span class=\"bumpedFont15\">With this ruling, the court upheld the rulings obtained by the lawyers of the Egyptian Center for Economic and Social Rights, at the Administrative Court in Mansoura, earlier, on behalf of three journalists, all of whom are members of the Journalists Syndicate.<\/span><\/span><\/p>\n<p class=\"s3\" style=\"text-align: left;\"><span class=\"s5\"><span class=\"bumpedFont15\">The lawsuits <\/span><\/span><span class=\"s5\"><span class=\"bumpedFont15\">filed by<\/span><\/span> <span class=\"s5\"><span class=\"bumpedFont15\">C<\/span><\/span><span class=\"s5\"><span class=\"bumpedFont15\">enter demanded the annulment of the decision of the governor of <\/span><\/span><span class=\"s5\"><span class=\"bumpedFont15\">Dakahlia<\/span><\/span><span class=\"s5\"><span class=\"bumpedFont15\"> to prevent three journalists from entering the governorate building, and to delete them from the WhatsApp group of journalists and media professionals, which deprived them <\/span><\/span><span class=\"s5\"><span class=\"bumpedFont15\">of<\/span><\/span><span class=\"s5\"><span class=\"bumpedFont15\"> access to information, and violated the principle of equal opportunities between different newspapers according to the provisions of the law.<\/span><\/span><\/p>\n<p class=\"s3\" style=\"text-align: left;\"><span class=\"s5\"><span class=\"bumpedFont15\">The center&#8217;s lawyers in <\/span><\/span><span class=\"s5\"><span class=\"bumpedFont15\">Dakahlia<\/span><\/span><span class=\"s5\"><span class=\"bumpedFont15\"> challenged the negative decision to refrain from enabling the appellants to cover news within the governorate, and not to enable them to communicate and obtain data, information, and news from various government agencies such as the <\/span><\/span><span class=\"s5\"><span class=\"bumpedFont15\">Dakahlia<\/span><\/span><span class=\"s5\"><span class=\"bumpedFont15\">Governorate Office, ministers&#8217; deputy, heads of cities, and all units and departments affiliated with the governorate, its conferences and executive meetings, as well as imposing a set of restrictions that impede providing information or making it available to them, which was supported by the court.<\/span><\/span><\/p>\n<p class=\"s4\" style=\"text-align: left;\"><span class=\"s5\"><span class=\"bumpedFont15\">The Center&#8217;s lawsuit was filed on the grounds that the appellants are journalists registered in the Syndicate of Journalists, specialized in <\/span><\/span><span class=\"s5\"><span class=\"bumpedFont15\">covering news within the governorate, and on the grounds that the constitution and law guarantee freedom of the press, and the freedom of the journalist to practice his<\/span><\/span><span class=\"s5\"><span class=\"bumpedFont15\">\/her<\/span><\/span><span class=\"s5\"><span class=\"bumpedFont15\"> work, without restrictions or harassment.<\/span><\/span><\/p>\n<p class=\"s3\"><span class=\"s5\"><span class=\"bumpedFont15\">According to what was stated in Article 9 of Law No. 180 of 2018 that \u201ca journalist or media <\/span><\/span><span class=\"s5\"><span class=\"bumpedFont15\">worker<\/span><\/span><span class=\"s5\"><span class=\"bumpedFont15\">has the right to publish information, data and news that the law does not prohibit disclosure<\/span><\/span><span class=\"s5\"><span class=\"bumpedFont15\">. G<\/span><\/span><span class=\"s5\"><span class=\"bumpedFont15\">overnment agencies and other public entities are obligated to establish a department, office or website to communicate with the press and media to enable the journalist or media <\/span><\/span><span class=\"s5\"><span class=\"bumpedFont15\">worker<\/span><\/span><span class=\"s5\"><span class=\"bumpedFont15\"> to <\/span><\/span><span class=\"s5\"><span class=\"bumpedFont15\">obtain<\/span><\/span><span class=\"s5\"><span class=\"bumpedFont15\">data, information and news.<\/span><\/span><\/p>\n<p class=\"s3\"><span class=\"s5\"><span class=\"bumpedFont15\">Article 10 of the same law also prohibits obstructing or preventing journalists from their work, stating that \u201cit is prohibited to impose any restrictions that impede the provision or availability of information, or prevent equal opportunities between the various print and electronic newspapers and audio-visual media, or their right to obtain information, all without <\/span><\/span><span class=\"s5\"><span class=\"bumpedFont15\">vi<\/span><\/span><span class=\"s5\"><span class=\"bumpedFont15\">olating the requirements of national security and defending the homeland.\u201d<\/span><\/span><\/p>\n<p class=\"s3\"><span class=\"s5\"><span class=\"bumpedFont15\">As for Article 12 of the Press Law, the journalist has the right to attend conferences, sessions and public meetings, to conduct meetings with citizens, and to photograph in public places with its text<\/span><\/span><span class=\"s5\"><span class=\"bumpedFont15\"> that stipulates:<\/span><\/span><span class=\"s5\"><span class=\"bumpedFont15\"> \u201cA journalist or media person in order to perform his work has the right to attend conferences, sessions and public meetings, conduct meetings with citizens, and photograph in places <\/span><\/span><span class=\"s5\"><span class=\"bumpedFont15\">p<\/span><\/span><span class=\"s5\"><span class=\"bumpedFont15\">hotographing the public is not prohibited, after obtaining the necessary permits in the cases that require it.\u201d<\/span><\/span><\/p>\n<p class=\"s3\"><span class=\"s5\"><span class=\"bumpedFont15\">Article 11 of the same law also states that \u201cwith due regard to the provisions of Articles (9 and 10) of this law, a journalist or media person has the right to receive an answer to any information, data and news <\/span><\/span><span class=\"s5\"><span class=\"bumpedFont15\">s\/<\/span><\/span><span class=\"s5\"><span class=\"bumpedFont15\">he is inquiring about, unless this information, data or <\/span><\/span><span class=\"s5\"><span class=\"bumpedFont15\">the<\/span><\/span><span class=\"s5\"><span class=\"bumpedFont15\"> news is confidential in nature or in accordance with the law.\u201d<\/span><\/span><\/p>\n<p class=\"s3\"><span class=\"s5\"><span class=\"bumpedFont15\">The lawsuits confirmed that the governor contested against him, in his capacity as he had prevented the appellants from performing their work since the beginning of June 2020, and used the authority of his position to refrain from issuing his decision to deal with the appellants as journalists in order to stop the provisions of the aforementioned press law, especially articles 9, 10, 11, 12 of Law 180 of the year 2018.<\/span><\/span><\/p>\n<p class=\"s3\"><span class=\"s5\"><span class=\"bumpedFont15\">Where the governorate deleted their used and private phone numbers from <\/span><\/span><span class=\"s5\"><span class=\"bumpedFont15\">a<\/span><\/span><span class=\"s5\"><span class=\"bumpedFont15\"> group called \u201cPress and Media\u201d, which is affiliated with the WhatsApp website, and established by the Department of Public Relations and Media in the governorate, to communicate with journalists, intending by its decision to ban, and restrict access to any information or its availability at the time that this grants <\/span><\/span><span class=\"s5\"><span class=\"bumpedFont15\">the<\/span><\/span><span class=\"s5\"><span class=\"bumpedFont15\"> right to obtain information and data for the rest of the other press institutions in a way that violates the principle of equal opportunities between the <\/span><\/span><span class=\"s5\"><span class=\"bumpedFont15\">different<\/span><\/span><span class=\"s5\"><span class=\"bumpedFont15\"> newspapers by suspending the implementation of the provisions of Article 10 of the previous law<\/span><\/span><span class=\"s5\"><span class=\"bumpedFont15\">. H<\/span><\/span><span class=\"s5\"><span class=\"bumpedFont15\">e also refrained from issuing his decision to correct this situation.<\/span><\/span><\/p>\n<p class=\"s3\"><span class=\"s5\"><span class=\"bumpedFont15\">Later, after the ruling was issued in favor of the journalists, the governor appealed the ruling, which was rejected by the court, in favor of the previous ruling, which supported the Egyptian Center\u2019s first lawsuit, demanding the annulment of the <\/span><\/span><span class=\"s5\"><span class=\"bumpedFont15\">Dakahlia<\/span><\/span><span class=\"s5\"><span class=\"bumpedFont15\">governor\u2019s decision to prevent the three journalists from entering the governorate building.<\/span><\/span><\/p>\n<p class=\"s4\"><span class=\"s5\"><span class=\"bumpedFont15\">It is a ruling that serves as a historical legal <\/span><\/span><span class=\"s5\"><span class=\"bumpedFont15\">un<\/span><\/span><span class=\"s5\"><span class=\"bumpedFont15\">precedent<\/span><\/span><span class=\"s5\"><span class=\"bumpedFont15\"> one<\/span><\/span><span class=\"s5\"><span class=\"bumpedFont15\">,<\/span><\/span><span class=\"s5\"><span class=\"bumpedFont15\"> issued for the first time in the Egyptian courts, and its effects extend to all the press community, in the face of any obstacles that hinder the performance of their journalistic work, which are guaranteed to them by the constitution and the law.<\/span><\/span><\/p>\n","protected":false},"excerpt":{"rendered":"<p>The Supreme Administrative Court, in its first circuit, rejected the appeal filed by the governor of Dakahlia in his capacity, against a number of journalists on the grounds of preventing them from entering the governorate building, and deleting them from the WhatsApp group of journalists and media professionals.
