{"id":771175,"date":"2012-10-09T10:46:57","date_gmt":"2012-10-09T08:46:57","guid":{"rendered":"https:\/\/wordpress-1226656-4371204.cloudwaysapps.com\/mans25\/?p=771175"},"modified":"2012-10-09T10:46:57","modified_gmt":"2012-10-09T08:46:57","slug":"ecesr-motion-in-the-case-to-nullify-the-constituent-assembly","status":"publish","type":"post","link":"https:\/\/ecesr.org\/en\/ecesr-motion-in-the-case-to-nullify-the-constituent-assembly\/","title":{"rendered":"ECESR Motion in the Case to Nullify the Constituent Assembly"},"content":{"rendered":"<h3 style=\"text-align: justify;\">Motion Reaffirms the Invalidity\u00a0of its Makeup and the Deviation of Morsi\u2019s Decision from Public Interest<\/h3>\n<p style=\"text-align: justify;\">The Egyptian Center for Economic and Social Rights filed a defense motion this\u00a0morning in the case filed by Khalid Ali to nullify the Constituent Assembly selected\u00a0to write the constitution against the chairman of the Joint Meeting of the People\u2019s\u00a0Assembly and the Shura Council, and which called for:<\/p>\n<p style=\"text-align: justify;\"><strong>First<\/strong>: In urgency: Stop the implementation of the chairman of the Joint Meeting of the\u00a0People\u2019s Assembly and Shura Council\u2019s decision for the elected members to choose\u00a0the constitution\u2019s constituent assembly, taken in 12\/06\/2012, including the consequent\u00a0events, the most important of which is the invalidity of the constitution\u2019s constituent\u00a0assembly.<\/p>\n<p style=\"text-align: justify;\"><strong>Second<\/strong>: (Request that was added to the requests during the hearing on 02\/10\/2012) in\u00a0urgency: Stop the implementation of the President\u2019s decision to ratify law 79 for the\u00a02012 that sets the standards for the election of the Constituent Assembly\u2019s members\u00a0selected to draft the country\u2019s new constitution, which was ratified July 11 2012 and\u00a0was published in the official gazette, issue number 28 dated July 12 2012<\/p>\n<p style=\"text-align: justify;\">On the subject: To cancel the challenged decisions and their consequent effects, and\u00a0oblige the contested parties to pay expenses and attorney\u2019s fees.<\/p>\n<p style=\"text-align: justify;\">The motion included four main arguments:<\/p>\n<p style=\"text-align: justify;\"><strong>First<\/strong>: The competency of the administrative judiciary to try the case.<\/p>\n<p style=\"text-align: justify;\"><strong>Second<\/strong>: The contested decision to form a constituent assembly weakens\u00a0the principle of legitimacy and rule of law.<\/p>\n<p style=\"text-align: justify;\"><strong>Third<\/strong>: The contested decision to form the constituent assembly this way is not based\u00a0on correct cause.<\/p>\n<p style=\"text-align: justify;\"><strong>Fourth<\/strong>: The President\u2019s decision to ratify law 79 for the year 2012 is a\u00a0misuse of power.<\/p>\n<p style=\"text-align: justify;\">_______<\/p>\n<p style=\"text-align: justify;\"><em><strong>Why is the President\u2019s decision considered void? Why is the President\u2019s decision a\u00a0<\/strong><\/em><em><strong>misuse of power?<\/strong><\/em><\/p>\n<p style=\"text-align: justify;\">The defense\u2019s motion states that \u201cThe insistence of the President to ratify law 79 for\u00a0the year 2012 in this way aims for a political end, which is protecting the constituent\u00a0assembly from being challenged, since the majority of its members are from the\u00a0Freedom and Justice Party, which was headed by Dr. Mohamed Morsi, and which\u00a0nominated him for the presidency. The constitutional declaration that was in effect\u00a0at the time the president ratified this law gives the Military Council the authority\/\u00a0power to choose the members of the constituent assembly if the courts ruled that it\u00a0was invalid. Therefore, this case\u2019s documents reveal a bitter political conflict between\u00a0the Military Council and the President and his political party. Each party used its\u00a0power and authority, and the decision to ratify law number 79 for the year 2012 was\u00a0made, despite the dissolution of the People\u2019s Assembly and nearly a month after the\u00a0Supreme Court\u2019s ruling. The case\u2019s documents show that it is clear that\u00a0the President\u2019s goals were not aimed at the public good, but rather to keep his party\u2019s\u00a0and political faction\u2019s control
