{"id":3497,"date":"2011-04-18T08:54:36","date_gmt":"2011-04-18T08:54:36","guid":{"rendered":"https:\/\/wordpress-1226656-4371204.cloudwaysapps.com\/?p=3497"},"modified":"2011-04-18T08:54:36","modified_gmt":"2011-04-18T08:54:36","slug":"the-egyptian-center-legal-proceedings-to-void-alzahera-agricultural-company-and-demands-to-freeze-all-legal-actions-on-100000-feddans-in-toshka","status":"publish","type":"post","link":"https:\/\/ecesr.org\/en\/the-egyptian-center-legal-proceedings-to-void-alzahera-agricultural-company-and-demands-to-freeze-all-legal-actions-on-100000-feddans-in-toshka\/","title":{"rendered":"The Egyptian Center: Legal Proceedings to Void alZahera Agricultural Company  And Demands To Freeze All Legal Actions on 100,000 Feddans in Toshka"},"content":{"rendered":"<p style=\"text-align: center;\"><a href=\"https:\/\/ecesr.org\/contents\/uploads\/2011\/04\/\u0627\u0645\u064a\u0646-\u0627\u0628\u0627\u0638\u06291.jpg\"><img decoding=\"async\" class=\"size-full wp-image-3498  aligncenter\" title=\"amen abaza\" src=\"https:\/\/ecesr.org\/contents\/uploads\/2011\/04\/-\u0627\u0628\u0627\u0638\u06291-e1303116825135.jpg\" alt=\"\" width=\"226\" height=\"180\" \/><\/a><\/p>\n<p>The Egyptian Center for Economic and Social Rights, today, filed a complaint to the Attorney General has also filed a lawsuit \u00a0before the administrative court\u00a0 regarding the same issue : to recover one hundred thousand feddans in Toshka that \u00a0have been illegally \u00a0allocated to alZahera\u00a0 Agricultural company for LE 50 per feddan .<\/p>\n<p>Lawyers at the center \u00a0filed the communique\u00a0 6525\u00a0\u00a0 \/2011 to \u00a0the Attorney General, against both\u00a0 Ahmed Nazif, the former prime minister in person and capacity ,Amin Abaza, \u00a0former minister of agriculture in person and capacity, and chairman of the general authority for rehabilitation and agricultural development projects, on charges of squandering public funds, and facilitating seizure of them. \u00a0ECESR demanded the suspending all legal actions on 100,000 feddans \u00a0allocated for alZahera \u00a0company \u00a0in Toshka area.<\/p>\n<p>At the same time, ECESR filed a lawsuit before the administrative court against the prime minister, minister of agriculture and land reclamation, chairman of the general authority for rehabilitation and agricultural development projects ,chairman of alZahera company,\u00a0 as per their capacities, calling for the invalidity of the contract regarding this stretch of land . The contracting parties ignored the auctions and tenders bill # 89 \/1998 and set the price to LE50 per feddan. ECESR argued that on 9\/2\/2011 the legislation and jurisprudence\u00a0 issue a resolution\u00a0 that this land was illegally allocated and that the contract\u00a0 violated article 30 of the bill 89\/1998 regarding the pricing and the maximum area to be allocated as per law 143\/1980.<\/p>\n<p>The Egyptian Center for Economic and Social Rights said ,&#8221; All community efforts must combine to recover the stolen money and to protect and recover \u00a0public territory which the former regime wasted by illegal allocations that undervalue this land&#8221;.<\/p>\n<p>The Egyptian Center for Economic and Social Rights welcomes the decision of the Attorney General to hold the land owned by Alwaleed Bin Talal \u00a0in Toshka and restraining it. The Center \u00a0also welcomes the decision of the general authority for tourism development to cancel the initial approval of \u00a0land allocation in phase three in Sahl Hasheesh , a project \u00a0of the Egyptian company for tourism resorts, owned by businessman Ibrahim Kamel.<\/p>\n<p>ECESR stressed that these decisions do not conflict with lawsuits filed before the administrative court \u00a0to recover this land , but are \u00a0complementary to public efforts to restore land. The court will eventually decide on \u00a0invalidity of contracting procedures.<\/p>\n<p>However, these companies may resort \u00a0to arbitration if the land was withdrew from them. It will be rather a legal conflict between parties ,government bodies and companies. The companies side is more powerful, particularly as the terms of the contract did not restrict \u00a0companies \u00a0with real commitments. As well theses companies can launch a crackdown on \u00a0Egyptian economy under the pretext of not breaking the contracts from their side \u00a0and that they were victims of the regime after the revolution, which incites against investment and is hostile to entrepreneurs.<\/p>\n<p>On the other hand , the court decision of contract invalidity, if issued by the administrative court , will be addressing contracting parties \u00a0and ruins the legal basis upon which this contract \u00a0was issued without going into details of partied commitments.\u00a0 The court decision will waste the chance of these companies to appear as victims, but will expose their role as participants and beneficiaries of deliberately wasting laws governing such contracts.<\/p>\n<p>On 26\/4\/2011, Cairo administrative court to will review the cases \u00a0: contract of Palm Hills in New Cairo ,owned by Mansour- Magrabi group \u00a0and in which Alaa Mubarak \u00a0is a share holder and the contract of alMamlaka company for agricultural development \u00a0in Toshka owned by Alwaleed bin Talal.
