The Court of Administrative Justice rejects the Minister of Tourism objection to the judgment for tourist guides

On March 28, 2023, the 4th Circuit in the Administrative Court, issued a a judgment to reject Objection No.37210 of Judicial year No.77 filed by the Minister of Tourism against a tourist guide. The Minister calls for staying the execution of the ruling issued by the Administrative Court for the interest of tourist guides in Case No. 1203 of the Judicial Year No.76 through which it was decided to abrogate the negative decision by refraining from giving them a license to establish tourism guide offices.

It is worth mentioning that the Supreme Administrative Court previously rejected the objection filed by the Minister of Tourism on the issued ruling in Lawsuit No.1203 of the Judicial year No.76. After the Administrative Court decided to reject the aforementioned opposition, the issued ruling for the interest of tourist guides has become final and executable.

Further to that, the Ministry of Tourism and the appointed committee to manage the Tour Guides Syndicate had applied a request to receive a Legal opinion from the State Council regarding the implementation of the ruling. The State Council’s General Assembly of Legal Opinion and Legislation Departments concluded its legal opinion last May, as it affirmed the impossibility of implementing the ruling because there is no legislative framework that regulates granting licenses to tourist guide services offices.

The Egyptian Center for Economic and Social Rights (ECESR) calls upon the Minister of Tourism, as he is the concerned one to set regulations and procedures related to that, to issue his decision to set the regulating procedures to authorize establishing tourist guides offices for tourist guides as an implementation to the judgment, so that they can obtain the necessary licenses to establish their own offices.
